আল্লাহর নামে, যিনি পরম করুণাময়, পরম দয়ালু
Surah 04 | An-Nisa | আন-নিসা | Verse: 11
- আল্লাহ তোমাদের সন্তান সম্বন্ধে নির্দেশ দিচেছন : এক পুত্রের অংশ দুই কন্যার অংশের সমান; কিন্তু শুধু কন্যা দুইয়ের বেশী থাকলে তাদের জন্য পরিত্যক্ত সম্পত্তির তিন ভাগের দু’ভাগ, আর মাত্র এক কন্য থাকলে তার জন্য অর্ধেক । তার সন্তান থাকলে তার পিতা-মাতা প্রত্যেকের জন্য পরিত্যক্ত সম্পত্তির ছয় ভাগের এক ভাগ; সে নিঃসন্তান হলে এবং পিতা-মাতাই উত্তরাধিকারী হলে তার মাতার জন্য তিন ভাগের এক ভাগ; তার ভাই-বোন থাকলে মাতার জন্য ছয় ভাগের এক ভাগ ; এ সবই সে যা ওসিয়াত করে তা দেয়ার এবং ঋণ পরিশোধের পর । তোমাদের পিতা ও সন্তানদের মধ্যে উপকারে কে তোমাদের নিকটতর তা তোমরা জান না । এ বিধান আল্লাহর; নিশ্চয় আল্লাহ সর্বজ্ঞ, প্রজ্ঞাময়।
এই আয়াতে আল্লাহ বলছেন :
আল্লাহ তোমাদেরকে তোমাদের সন্তানদের সম্পর্কে নির্দেশ দিচ্ছেন,
- এক ছেলের জন্য দুই মেয়ের অংশের সমপরিমাণ।
- তবে যদি দুইয়ের অধিক মেয়ে হয়, তাহলে তারা পাবে মোট সম্পত্তির দুই-তৃতীয়াংশ ।
- আর যদি একজন মেয়ে হয়, তখন সে পাবে অর্ধেক।
- তাঁর বাবা-মায়ের মধ্যে, যদি তার সন্তান থাকে, তাহলে প্রত্যেকে পাবে ছয় ভাগের এক ভাগ।
- আর যদি তার সন্তান না থাকে এবং কেবল তার বাবা-মাই উত্তরাধিকারী হয়, তাহলে তার মায়ের জন্য এক-তৃতীয়াংশ।
- আর যদি তার ভাই-বোন থাকে তবে তার মায়ের জন্য ছয় ভাগের এক ভাগ।
- (এই হিসাব হবে) সেই ওসিয়ত পূরণের পর যা সে করে গেছে, অথবা কোনো ঋণ পরিশোধ করার পর।
- তোমাদের মাতা পিতা ও তোমাদের সন্তান-সন্ততিদের মধ্য থেকে তোমাদের উপকারে কে অধিক নিকটবর্তী তা তোমরা জান না।
- এই ভাগ-বণ্টন আল্লাহর পক্ষ থেকে নির্ধারিত। নিশ্চয়ই আল্লাহ সর্বজ্ঞ, প্রজ্ঞাময়।
বুঝতে সাহায্য করে এমন একটি গল্প
হাসান নামের এক ভালো মানুষ ছিলেন। তিনি তাঁর ছোট্ট একটা বাগান বাড়িতে স্ত্রী, দুই মেয়ে, এক ছেলে ও তাঁর বৃদ্ধ মা-বাবাকে নিয়ে থাকতেন। তিনি খুবই সৎ এবং আল্লাহর নিয়ম মেনে চলতেন।
একদিন হাসান হঠাৎ অসুস্থ হয়ে পড়লেন। মৃত্যুর আগে তিনি তাঁর ছেলেমেয়েদের বললেন, “ আমার প্রিয় সন্তানরা, আমি মারা গেলে আল্লাহর নিয়ম মতো আমার জিনিসপত্র ভাগ করে নিও।”
হাসানের মৃত্যুর পর তাঁর সন্তানরা কাঁদতে কাঁদতে তাঁর রেখে যাওয়া জিনিসগুলো দেখছিল । তখন তাঁর ছেলে বলল, “আমরা কীভাবে ভাগ করব, ভাই-বোনদের মধ্যে ঝগড়া না হয় তো?”
তখন তাঁদের দাদি বললেন, “ আমার সন্তানরা, আল্লাহ নিজেই আমাদের শিখিয়েছেন, কে কত পাবে। এটি কুরআনের নিয়ম। আসো আমি তোমাদের বলি...”
কুরআনের নিয়ম অনুযায়ী ব্যাখ্যা:
ছেলে-মেয়েদের ক্ষেত্রে:
- যদি একজন ছেলে ও দুই মেয়ে থাকে, তাহলে ছেলেটা পাবে দুই মেয়ের সমান।
- যেমন: যদি মোট সম্পদ হয় ৬ টাকা, তাহলে ছেলেটা পাবে ৩ টাকা, আর প্রতিটি মেয়ে পাবে ১.৫ টাকা করে।
শুধু মেয়েরা থাকলে:
- যদি শুধু মেয়ে থাকে, দুই বা তার বেশি, তাহলে তারা সবাই মিলে পাবে দুই-তৃতীয়াংশ।
- যেমন: ৬ টাকার মধ্যে তারা পাবে ৪ টাকা — নিজেদের মধ্যে সমান ভাগ করে।
- যদি শুধু একজন মেয়ে থাকে, তাহলে সে পাবে অর্ধেক।
মা-বাবার ক্ষেত্রে:
- হাসানের মা-বাবা যদি বেঁচে থাকতেন, এবং তাঁর সন্তান থাকত, তবে মা-বাবা প্রত্যেকে পেতেন এক-ষষ্ঠাংশ।
- এখানে:
- “তাঁর সন্তান” মানে হাসানের সন্তান।
- অর্থাৎ, হাসান মারা গেছেন, এখন তার রেখ ে যাওয়া সম্পদ ভাগ হবে।
- সেই প্রেক্ষিতে হাসানের মা-বাবা যদি বেঁচে থাকেন, এবং হাসানের সন্তান থাকে, তবে মা-বাবা প্রত্যেকে ১/৬ (এক-ষষ্ঠাংশ) করে পাবেন।
- এখানে:
- হাসানের মা-বাবা যদি বেঁচে থাকতেন, এবং যদি হাসানের কোনো সন্তান না থাকত, তবে
- হাসানের মা পেতেন: : ১/৩ (এক-তৃতীয়াংশ)
- হাসানের বাবা পেতেন: : বাকি সব, অর্থাৎ ২/৩ (দুই-তৃতীয়াংশ)
- যদি হাসানের ভাই-বোন থাকত, এবং যদি হাসানের কোনো সন্তান না থাকত
- হাসানের মা পেতেন: : ১/৬ (এক-ষষ্ঠাংশ)
- হাসানের বাবা পেতেন: : বাকি অংশ (৫/৬)
Allah instructs you concerning your children: for the male, what is equal to the share of two females. But if there are [only] daughters, two or more, for them is two thirds of one's estate. And if there is only one, for her is half. And for one's parents, to each one of them is a sixth of his estate if he left children. But if he had no children and the parents [alone] inherit from him, then for his mother is one third. And if he had brothers [or sisters], for his mother is a sixth, after any bequest he [may have] made or debt. Your parents or your children - you know not which of them are nearest to you in benefit. [These shares are] an obligation [imposed] by Allah. Indeed, Allah is ever Knowing and Wise.
In this verse, Allah says:
Allah instructs you regarding your children :
- A male will receive a share equal to that of two females.
- If there are more than two daughters, they will share two-thirds of the total inheritance.
- If there is only one daughter, she will receive half of the inheritance.
- As for the parents, if the deceased had children, each parent will receive one-sixth.
- If the deceased had no children and only the parents are inheriting, then the mother will receive one-third.
- But if the deceased had siblings, the mother will receive one-sixth.
- (This division is to be carried out) after fulfilling any will the deceased has made and after paying off any debts.
- You do not know which of your parents or children is closer to you in benefit.
- This is an obligation from Allah. Indeed, Allah is All-Knowing, All-Wise.
A story that helps to understand
There was a kind man named Hasan. He lived in a small garden house with his wife, two daughters, one son, and his elderly parents. Hasan was an honest man who always followed the rules of Allah.
One day, Hasan suddenly became very ill. Before passing away, he told his children: “My dear children, after I’m gone, divide my belongings according to the laws of Allah.”
After Hasan's death, his children looked at what he had left behind, tears in their eyes. Then his son said: “How do we divide everything fairly? I hope there won’t be any arguments between us.”
At that moment, their grandmother gently said: “My children, Allah Himself has taught us how to divide inheritance. It is written in the Qur'an. Come, let me explain...”
According to the Qur’anic rules:
For sons and daughters:
- If there is one son and two daughters, the son will receive as much as two daughters combined. For example, if the total inheritance is 6 coins:
- The son gets 3 coins,
- Each daughter gets 1.5 coins.
If there are only daughters:
- If there are two or more daughters, and no son, they together receive two-thirds of the total inheritance. For example, out of 6 coins, the girls together get 4 coins, divided equally among them.
- If there is only one daughter, she receives half of the inheritance.
For parents:
- If Hasan’s parents were alive, and he had children, then each parent would receive one-sixth (1/6) of the inheritance.
- Here,
- “his children” means Hasan’s children.
- Since Hasan has passed away, now his inheritance must be divided.
- So if Hasan’s parents are alive and he has children, then his mother gets 1/6 and his father also gets 1/6.
- Here,
If Hasan had no children:
- And if only his parents were alive (no wife or siblings):
- His mother would get 1/3 of the inheritance.
- His father would receive the remaining 2/3.
If Hasan had siblings but no children:
- His mother would receive only 1/6.
- His father would receive the remaining part — that is, 5/6.
Surah 04 | An-Nisa | আন-নিসা | Verse: 12
- তোমাদের স্ত্রীদের পরিত্যক্ত সম্পত্তির অর্ধেক তোমাদের জন্য, যদি তাদের কোন সন্তান না থাকে এবং তাদের সন্তান থাকলে তোমাদের জন্য তাদের পরিত্যক্ত সম্পত্তির চার ভাগের এক ভাগ; ওসিয়ত পালন এবং ঋন পরিশোধের পর। তোমাদের সন্তান না থাকলে তাদের জন্য তোমাদের পরিত্যক্ত সম্পত্তির চার ভাগের এক ভাগ, আর তোমাদের সন্তান থাকলে তাদের জন্য তোমাদের পরিত্যক্ত সম্পত্তির আট ভাগের এক ভাগ; তোমরা যা ওসিয়াত করবে তা দেয়ার পর এবং ঋণ পরিশোধের পর । আর যদি কোন পুরুষ অথবা নারীর ‘ কালালাহ ' বা পিতা-মাতা ও সন্তানহীন উত্তরাধিকারী হয়, আর থাকে তার এক বৈপিত্রেয় ভাই বা বোন, তবে প্রত্যেকের জন্য ছয় ভাগের এক ভাগ। তারা এর বেশী হলে সবাই সমান অংশীদার হবে তিন ভাগের এক ভাগে; এটা যা ওসিয়াত করা হয় তা দেয়ার পর এবং ঋণ পরিশোধের পর, কারো ক্ষতি না করে । এ হচ্ছে আল্লাহর নির্দেশ। আর আল্লাহ সর্বজ্ঞ, সহনশীল।
এই আয়াতে আল্লাহ বলছেন :
- তোমাদের (স্বামীদের) জন্য রয়েছে তোমাদের স্ত্রীর রেখে যাওয়া সম্পদের অর্ধেক, যদি তাদের কোনো সন্তান না থাকে।
- কিন্তু যদি তাদের সন্তান থাকে, তাহলে তোমরা পাবে চার ভাগের এক ভাগ (১/৪) — তবে এর আগে যে ওসিয়ত (উইল) তারা করে গেছে তা পূরণ করতে হবে এবং যদি কোনো ঋণ থেকে থাকে, তা শোধ করতে হবে।
- আর স্ত্রীরা পাবে তাদের স্বামীর সম্পদের এক-চতুর্থাংশ (১/৪), যদি স্বামীর কোনো সন্তান না থাকে।
- কিন্তু যদি স্বামীর সন্তান থাকে, তাহলে স্ত্রীরা পাবে আট ভাগের এক ভাগ (১/৮) — এটি হবে স্বামীর উইল ও ঋণ মেটানোর পর।
- যদি কোনো পুরুষ বা নারী মারা যায় এবং তার বাবা-মা বা সন্তান না থাকে (এটিকে বলে কালালাহ), কিন্তু তার (বৈপিত্রেয়) ভাই বা বোন থাকে:
- তাহলে প্রতিটি ভাই বা বোন পাবে ছয় ভাগের এক ভাগ (১/৬)।
- কিন্তু যদি ভাই-বোন একাধিক হয়, তাহলে তারা সবাই মিলে পাবে এক-তৃতীয়াংশ (১/৩) — উই ল ও ঋণ মেটানোর পর, কাউকে ক্ষতি না করে।
- এটি আল্লাহর পক্ষ থেকে নির্ধারিত নিয়ম। আর আল্লাহ সবকিছু জানেন এবং অতি সহনশীল ।
- And for you is half of what your wives leave if they have no child. But if they have a child, for you is one fourth of what they leave, after any bequest they [may have] made or debt. And for the wives is one fourth if you leave no child. But if you leave a child, then for them is an eighth of what you leave, after any bequest you [may have] made or debt. And if a man or woman leaves neither ascendants nor descendants but has a brother or a sister, then for each one of them is a sixth. But if they are more than two, they share a third, after any bequest which was made or debt, as long as there is no detriment [caused]. [This is] an ordinance from Allah, and Allah is Knowing and Forbearing.
In this verse, Allah says:
- You (husbands) will receive half of what your wives leave behind if they have no children.
- But if they do have children, then you will receive one-fourth (¼) — after fulfilling any will they made and paying any debts they owed.
- Wives will receive one-fourth (¼) of what their husbands leave behind if the husbands have no children.
- But if the husbands do have children, then the wives will receive one-eighth (⅛) — after fulfilling the will and paying any debts.
- If a man or woman dies and has neither parents nor children (this is called kalālah), but has a maternal half-brother or half-sister:
- Then each sibling will receive one-sixth (1/6).
- But if there are more than one, they will share one-third (⅓) equally — again, after fulfilling any will or debt, and without causing harm to anyone.
- These are fixed rules from Allah. And Allah is All-Knowing and Most Forbearing.
Surah 04 | An-Nisa | আন-নিসা | Verse: 13 - 14
- এসব আল্লাহর নির্ধারিত সীমা। কেউ আল্লাহ্ ও তাঁর রাসূলের আনুগত্য করলে আল্লাহ তাকে প্রবেশ করাবেন জান্নাতে, যার পাদদেশে নদী প্রবাহিত; তারা সেখানে স্থায়ী হবে আর এটাই হলো মহাসাফল্য।
- আর কেউ আল্লাহ ও তার রাসূলের অবাধ্য হলে এবং তার নির্ধারিত সীমা লংঘন করলে তিনি তাকে আগুনে নিক্ষেপ করবেন; সেখানে সে স্থায়ী হবে এবং তার জন ্য লাঞ্ছনাদায়ক শাস্তি রয়েছে।
- These are the limits [set by] Allah, and whoever obeys Allah and His Messenger will be admitted by Him to gardens [in Paradise] under which rivers flow, abiding eternally therein; and that is the great attainment.
- And whoever disobeys Allah and His Messenger and transgresses His limits - He will put him into the Fire to abide eternally therein, and he will have a humiliating punishment.
